NOTICES OF PROPOSED RULES (The date in parentheses is the date the rules were filed in the Legislative Research Council):

Department of Social Services (January 7, 1998) pursuant to SDCL 1-36-20 intends to adopt mandatory changes to the food stamp rule that were published in the Federal Register on December 8, 1997. The federal rules update for fiscal year 1998 the maximum food stamp allotment levels which a household is eligible to receive and the maximum gross and net income which a household may receive and be eligible for food stamps. The general authority, as cited by the department, is SDCL 28-12-1.

Copies of the proposed rule may be obtained from Jill Wellhouse, Department of Social Services, 700 Governors Drive, Pierre, South Dakota 57501.

Department of Commerce and Regulation: State Banking Commission (January 9, 1998) is proposing to reduce the semiannual state examination fee. The general authority, as cited by the agency, is SDCL 51A-2-13 and 51A-2-36.

A public hearing will be held at the office of the South Dakota Division of Banking, 2172 West Missouri Avenue, Pierre, on February 10, 1998, at 10:00 a.m. Written comments may be sent to the State Banking Commission, Division of Banking, 500 East Capitol, Pierre, South Dakota 57501, and must reach the commission by February 10, 1998, to be considered. Copies of the proposed rules may be obtained from the same address. If persons with disabilities require special accommodations, they are asked to advise the Division of Banking 48 hours before the hearing at (605) 773-3421.

DEPARTMENT OF REVENUE clarified when gross receipts received by a retailer or franchisor as a cost share or reimbursement for purchases of exempt advertising services made by the retailer or franchisor are not subject to sales tax, ARSD 64:06:02:03.01 and 03.02; and made gross receipts received for medical expert testimony and consulting services subject to sales tax, 64:06:02:87.
