NOTICES OF PROPOSED RULES (The date in parentheses is the date the rules were filed in the Legislative Research Council):

Department of Social Services (January 20, 1998) pursuant to SDCL 1-36-20 intends to adopt mandatory changes to eligibility requirements for

medical assistance pursuant to Public Law 105-33, the Balance Budget Act of 1997. The rules provide payment of certain Medicare costs for individuals who are eligible for Medicare but whose income is between 120 and 175 percent of the federal poverty level for a family of the size involved and who are not otherwise eligible for Medicaid, provide Medicaid eligibility for disabled children who lost their Supplemental Security Income benefits due to the new definition of a disabled child, and allow the state to continue enforcing a resource test when determining eligibility for a pregnant woman but remove the resource test when determining eligibility for children whose family income is below certain poverty levels. The general authority for these rules, as cited by the department, is SDCL 28-6-1.

Department of Transportation: South Dakota Transportation Commission (January 23, 1998) is considering the amendment of rules on speed limits in Pennington County on State Trunk Highway 44 and U.S. Highway 16, in Codington County on U.S. Highway 212, and in Lyman County on U.S. Highway 83. The general authority for these rules, as cited by the agency, is SDCL 32-25-7.

A public hearing will be held on February 26, 1998, at 10:00 a.m. in the Commission Room in the Becker-Hansen Building, Pierre. Written comments may be sent to the Secretary of Transportation, 700 East Broadway Avenue, Pierre, South Dakota 57501, before the date of the hearing. Copies of the proposed rules may be obtained from the same address.
