NOTICES OF PROPOSED RULES (The date in parentheses is the date the rules were filed in the Legislative Research Council):

Department of Commerce and Regulation: (January 26, 1999) is proposing rules that would correct a spelling error in the definitions, update references to the Uniform Standards of Professional Appraisal Practice, revise continuing education deferral, implement approval of specific educational courses, require 28 hours of continuing education documentation to be reported every odd numbered year including at least eight hours of approved instruction of the Uniform Standards of Professional Appraisal Practice. The general authority for these rules, as cited by the department, is SDCL 36-21B-3.

A public hearing will be held in the First Floor Conference Room, Commerce Building, 118 West Capitol, Pierre, SD, on Friday, February 26, 1999, at 1:30 p.m. Copies of the rules may be obtained from and written comments sent to the Department of Commerce, Appraiser Certification Program, 118 West Capitol, Pierre, SD 57501, and must be received by February 25, 1999, in order to be considered. This hearing is being held in a physically accessible place. Persons who have special needs for which the agency can make arrangements are asked to call (605) 773-4608 at least forty-eight hours before the hearing.

Department of Game, Fish and Parks: (January 27, 1999) is considering rules that would repeal waterfowl and game bird refuges in Brown, McPherson, Day, Clark, and Kingsbury Counties; amend rules that would permit use of amphibious and all terrain vehicles to access waterfowl hunting areas; and exempt department employees from certain zoning prohibitions on public waters while performing their duties. The general authority for these rules, as cited by the department, is SDCL 42-8-1.1 and 41-2-18.

A public hearing will be held at the Ramkota River Centre in Pierre, SD, on March 4, 1999, at 2:00 p.m. Copies of the rules may be obtained from and written comments sent to John Cooper, Secretary, Department of Game, Fish and Parks, 523 East Capitol, Pierre, SD 57501, and must be received prior to the hearing date in order to be considered. Comments may also be sent by e-mail to scottc@gfp.state.sd.us. E-mail comments must include the commenter's name and address. Persons who have special needs for which the agency can make arrangements are asked to call (605) 773-3387 at least forty-eight hours before the hearing.

Executive Appointments:

Richard C. Frederick, Mitchell, was appointed on January 6, 1999, to the Planning Council on Developmental Disabilities, to replace Sylvia Henkin, effective immediately, and to continue until July 1, 2000.

Ronald F. Williamson, Sioux Falls, was appointed on January 26, 1999, to the State Fair Commission, to replace Benjamin J. Stoick, effective immediately, and to continue until January 1, 2003.
