NOTICES OF PROPOSED RULES: (The date in parentheses is the date the rules were filed in the Legislative Research Council)

DEPARTMENT OF SOCIAL SERVICES: (March 21, 2000) is proposing rules relating to hospital services, optometry services, and transportation services paid by the department. The rules will update and clarify existing rules, institute form and style changes, and will increase rates for certain Medicaid providers and services. The general authority for these rules, as cited by the department, is SDCL 28-6-1.

A public hearing will be held on Wednesday, April 12, 2000, at 1:15 p.m., in Conference Room 1, Kneip Office Building, 700 Governors Drive, Pierre, South Dakota. Copies of the proposed rules may be obtained from and written comments sent to Jill Wellhouse, Administrative Rules, Department of Social Services, 700 Governors Drive, Pierre, South Dakota 57501. Ms. Wellhouse may be contacted by telephone at (605) 773-3305. Material sent by mail must reach the department by April 24, 2000, to be considered. This hearing is being held in a physically accessible place. Persons who have special needs for which the department can make arrangements are asked to call (605) 773-3305 at least forty-eight hours before the hearing.

DEPARTMENT OF EDUCATION AND CULTURAL AFFAIRS: STATE HISTORICAL SOCIETY: (March 22, 2000) intends to adopt rules to adjust fees or clarify criteria for certain services, update terms for the Deadwood Preservation Fund, clarify procedures for preservation of government records, and clarify procedures regarding the historical preservation loan and grant fund. The general authority for these rules, as cited by the department, is SDCL 1-18-31.2, 1-18C-12, 1-19A-5, 1-19A-13.5, 1-19A-29, 1-20-21.1,42-7B-4, 42-7B-5, and 42-7B-46.

A public hearing will be held at the Cultural Heritage Center, 900 Governors Drive, Pierre, South Dakota, on April 14, 2000, at 8:35 a.m. Copies of the proposed rules may be obtained from and written comments sent to the South Dakota State Historical Society, 900 Governors Drive, Pierre, South Dakota 57501-2217, and must be received by April 13, 2000, to be considered. This hearing is being held in a physically accessible place. Persons who have special needs for which the department can make arrangements are asked to call (605) 773-3458 at least forty-eight hours before the hearing.

Rules Review Committee Meetings

The next meeting of the Interim Rules Review Committee will be held Wednesday, April 19, 2000, in Legislative Conference Rooms 1 and 2 of the State Capitol, Pierre, starting at 9:00 a.m. The committee chair has set the following tentative meeting schedule for the 2000 interim: June 7, July 11, August 16, September 12, October 18, November 14, and December 12. Agencies whose rules have had a public hearing are asked to have a representative present at the meeting to give background information on their rules.
