Department of Commerce and Regulation: State Banking Commission (March 31, 1998) intends to set an application fee for a loan production office. The general authority for these rules, as cited by the agency, is SDCL 51A-2-13.

A public hearing will be held on April 28, 1998, at 11:00 a.m., at the Division of Banking, 2172 West Missouri, Pierre. Copies of the rules may be obtained from and written comments sent to the State Banking Commission, Division of Banking, 500 East Capitol, Pierre, South Dakota 57501, and must be received by April 28, 1998, to be considered. Persons who have special needs for which the agency can make arrangements are asked to call (605) 773-3421 within 48 hours of the hearing.

Department of Commerce and Regulation: State Banking Commission (March 31, 1998) intends to set original and renewal license fees for mortgage lenders and brokers. The general authority for these rules, as cited by the agency, is SDCL 54-14-10.

Public Utilities Commission (March 31, 1998) intends to adopt rules to establish new administrative procedures for the licensing and supervision of grain warehouses and grain dealers and establish standards for the submission of financial information to the commission and to bring rules into compliance with statutory changes. The general authority for these rules, as cited by the agency, is SDCL 49-42-2.1 and 49-45-6.

A public hearing will be held on April 30, 1998, at 9:00 a.m., in Room 412, Fourth Floor, State Capitol, Pierre. Copies of the proposed rules may be obtained from and written comments may be sent to the South Dakota Public Utilities Commission, 500 East Capitol Avenue, Pierre, South Dakota 57501, and must be received by April 30, 1998, to be considered. Department of Commerce and Regulation: South Dakota Real Estate Commission (April 3, 1998) intends to revise the procedure for real estate license examination and application, revise continuing education requirements, require training for certain real estate course providers, and effect syntax and grammatical changes. The general authority for these rules, as cited by the agency, is SDCL 36-21A-30.1, 36-21A-31, 36-21A-34, 36-21A-49, 36-21A-61, 36-21A-63, and 36-21A-89.

A public hearing will be held on May 6, 1998, at 9:00 a.m., in the second floor conference room, Commerce Building, 118 West Capitol Avenue, Pierre. Written comments may be sent to the South Dakota Real Estate Commission, 118 West Capitol Avenue, Pierre, South Dakota 57501, and must be received by May 4, 1998, to be considered. Copies of the proposed rules may be obtained from the same address. FILINGS IN THE SECRETARY OF STATE'S OFFICE:

Executive Orders:

Executive Order 98-03, dated April 1, 1998, declares that the offices for state government shall be administratively closed for the afternoon of Friday, April 10, 1998. This declaration applies only to state employees within the executive branch of state government under the immediate control of the Governor. All other units of government and the private business sector are to make independent judgments on this matter.

RULES REVIEW COMMITTEE MEETING:

The next meeting of the Interim Rules Review Committee will be held April 22, 1998, in Rooms LCR 1 and 2, Third Floor, State Capitol, Pierre, starting at 9:00 a.m. Agencies whose rules have had a public hearing are asked to have a representative present at the meeting to give background information on their rules.
