NOTICES OF PROPOSED RULES: (The date in parentheses is the date the rules were filed in the Legislative Research Council)

Department of Labor: Division of Labor and Management (April 25, 2000) is proposing rules to update the worker's compensation fee schedule, life expectancy table, and pre-hearing procedure and to revise the procedure for requesting conciliation. The general authority for these rules, as cited by the division, is SDCL 3-18-6, 62-2-5, and 62-7-6.

A public hearing will be held in Conference Room 1, First Floor, Kneip Building, 700 Governors Drive, Pierre, South Dakota, on June 2, 2000, at 10:00 a.m. Copies of the proposed rules may be obtained from and written comments sent to the South Dakota Department of Labor, Division of Labor and Management, Kneip Building, 700 Governors Drive, Pierre, South Dakota 57501-2291. Persons who have special needs for which the division can make arrangements are asked to call (605) 773-3681 before the hearing.

Department of Environment and Natural Resources: Board of Minerals and Environment (April 27, 2000) is considering rules which will ensure that facilities generating, transporting, treating, storing, or disposing of hazardous wastes are managing their wastes in compliance with hazardous waste rules and in an environmentally sound manner. The general authority for these rules, as cited by the board, is SDCL 34A-11-8 and 34A-11-9.

A public hearing will be held at the Floyd Matthew Environmental Education and Training Center, 523 East Capitol, Pierre, South Dakota, on July 20, 2000, at 10:00 a.m. Copies of the proposed rules may be obtained from and written comments sent to the Department of Environment and Natural Resources, Waste Management Program, 523 East Capitol, Pierre, South Dakota 57501-3181. This hearing is being held in a physically accessible place. Persons who have special needs for which the department can make arrangements are asked to call (605) 773-3153 at least forty-eight hours before the hearing.

Executive Appointment:

Thomas P. Hawkinson, Rapid City, was appointed on April 14, 2000, to the Board of Technical Professions, to replace Ardyce Gackstetter, effective immediately, and to continue until April 14, 2002.

CORRECTION: On page 140 of the Register, dated April 17, 2000, under Filings in the Secretary of State's Office, delete "41:04:02:12" and insert "41:04:02:14".

Rules Review Committee Meetings

The next meeting of the Interim Rules Review Committee will be held Wednesday, June 7, 2000, in Legislative Conference Rooms 1 and 2 of the State Capitol, Pierre, starting at 9:00 a.m. The committee chair has set the following tentative meeting schedule for the 2000 interim: July 11, August 16, September 12, October 18, November 14, and December 12. Agencies whose rules have had a public hearing are asked to have a representative present at the meeting to give background information on their rules.

Each agency is requested to provide the LRC with eight copies of the most recent draft of its rules two days before the meeting.
