NOTICES OF PROPOSED RULES: (The date in parentheses is the date the rules were filed in the Legislative Research Council)

Department of Environment and Natural Resources: (May 22, 2001) is proposing rules to update existing hazardous waste rules to include technical corrections of the treatment standards for certain hazardous wastes, revise the storage period for specific wastes generated by electroplating operations, and make technical corrections to the standards for hazardous air pollutants for certain hazardous waste combustion devices. The general authority for these rules, as cited by the department, is SDCL 34A-11-8 and 34A-11-9.

A public hearing will be held on Thursday, July 19, 2001, at 10:15 a.m. CDT, at the Floyd Matthew Environmental Education and Training Center, 523 East Capitol Avenue, Pierre, South Dakota. Copies of the proposed rules may be obtained from and written comments sent to Department of Environment and Natural Resources, Waste Management Program, 523 East Capitol Avenue, Pierre, South Dakota 57501-3181. This hearing is being held in a physically accessible place. Persons who have special needs for which the department can make arrangements may call (605) 773-3153 at least forty-eight hours before the hearing.

Department of Commerce and Regulation: Commission on Gaming: (May 25, 2001) intends to adopt rules to prohibit licensed employees of a satellite facility from wagering at their place of employment, to adopt a variation of blackjack, adopt variations of poker, adopt suggestions made by Gaming Laboratories International, Inc., relating to slot machine specifications, to provide uniformity of the rules following the implementation of $100 bet limits, to bring the rules into current practices of the industry, to provide for a two-dollar fifty cent chip, to correct and update rules relating to destruction of discontinued tokens, and to allow for the use of digital video recorders in closed circuit surveillance systems to keep pace with current technology. The general authority for these rules, as cited by the commission, is SDCL 42-7-56, 42-7B-7 and 42-7B-11.

A public hearing will be held on Friday, June 22, 2001, at 9:00 a.m., at City Hall, 102 Sherman Street, Deadwood, South Dakota. Copies of the proposed rules may be obtained from and written comments sent to the South Dakota Commission on Gaming, 118 West Capitol Avenue, Pierre, South Dakota 57501-2017, and must be received by Monday, June 18, 2001 to be considered. This hearing is being held in a physically accessible place. Persons who have special needs for which the commission can make arrangements are asked to call (605) 773-6050 or (605) 578-3074 at least forty-eight hours before the hearing.

Executive Appointments:

Thomas Ranfranz, Flandreau, was appointed on April 20, 2001, to the Citizens' Education Review Panel, effective immediately and to continue at the pleasure of the Governor.

William J. Locken, Spearfish, was appointed on April 23, 2001, to the Veterans Commission, to replace William Tarrell, effective immediately and to continue until October 1, 2005.

John W. Mitchell, Pierre, was reappointed on April 27, 2001, to the South Dakota Aeronautics Commission, effective July 1, 2001, and to continue to July 1, 2006.

Mary S. Carpenter, Winner, was appointed on May 2, 2001, to the Drug and Alcohol Abuse Advisory Council, to replace William Sorrels, effective immediately and to continue until July 1, 2002.

Jerry C. Schroeder, Hot Springs, was appointed on May 4, 2001, to the Statewide One-Call Notification Center Board, to replace Howard Meyer, effective immediately and to continue until November 1, 2001.

Kevin Forsch, Ft. Pierre, was reappointed on May 11, 2001, to the State Plumbing Commission, effective immediately and to continue until April 14, 2005.

Rules Review Committee Meetings

The next meeting of the Interim Rules Review Committee will be held on Tuesday, June 12 at 9:00 a.m. in Room 413 of the State Capitol. The committee chair has set the following tentative meeting schedule for the 2001 interim: August 7, October 8, and November 28.

Agencies whose rules have had a public hearing will be scheduled to meet with the Rules Review Committee and are asked to have a representative present at the meeting to give background information on their rules.
