NOTICES OF PROPOSED RULES (The date in parentheses is the date the rules were filed in the Legislative Research Council):

Department of Commerce and Regulation: Board of Pharmacy (July 27, 1998) is proposing to adopt rules which will increase the renewal license fee for pharmacists licensed in South Dakota. The general authority for these rules, as cited by the agency, is SDCL 36-11-11.

A public hearing will be held in Sioux Falls, on Friday, August 21, 1998, at the office of the South Dakota Board of Pharmacy, 4305 South Louise Avenue, Suite 104, at 1:00 p.m. Copies of the rules may be obtained and written comments sent to the South Dakota Board of Pharmacy, 4305 South Louise Avenue, Suite 104, Sioux Falls, South Dakota 57106. Written comments must be received by August 20, 1998, to be considered. For access assistance, persons who have special needs may call the Board of Pharmacy at (605) 362-2737 before the hearing.

Department of Commerce and Regulation: Division of Insurance (July 28, 1998) intends to adopt rules to allow the sale of high deductible plan F and J Medicare supplemental policies, to implement guaranteed issue and portability requirements for Medicare supplement policies, and to specify the current benefits in plans A-J, and high deductible F and J limits. The general authority for these rules, as cited by the agency, is SDCL 58-17A-2

A public hearing will be held on Thursday, August 20, 1998, at 9 a.m. in the first floor conference room of the Commerce Building, 118 West Capitol Avenue, Pierre. Copies of the rules may be obtained and written comments sent to the South Dakota Division of Insurance, 118 West Capitol Avenue, Pierre, South Dakota, 57501-2000, and must be received by Monday, August 31, 1998, to be considered. Executive Appointments:

Lawrence C. Porter, Brookings, was appointed on July 30, 1998, to the South Dakota Board of Counselor Examiners to replace Dr. Richard L. Roberts, effective August 1, 1998, and to continue until July 1, 2001.

Nancy Schade, Pierre, was reappointed on July 23, 1998, to the Board of Vocational Rehabilitation, effective immediately and to continue until July 1, 1999.

Randall Meendering, Huron, was reappointed on July 23, 1998, to the Board of Vocational Rehabilitation, effective immediately and to continue until July 1, 2000.

 

 

Carol A. Robertson, Eagle Butte, was appointed on July 23, 1998, to the Board of Vocational Rehabilitation to replace Jennifer Logan, effective immediately and to continue until July 1, 2001.

Eileen Kearney, Redfield, was reappointed on July 23, 1998, to the Board of Vocational Rehabilitation, effective immediately and to continue until July 1, 2000.

Richard L. Hicks, Sioux Falls, was reappointed on July 23, 1998, to the Board of Vocational Rehabilitation, effective immediately and to continue until July 1, 1999.

Pamela Hericks, Pierre, was appointed on July 24 1998, to the Board of Vocational Rehabilitation to replace Paul Kittelson, effective immediately and to continue until July 1, 2001.

Beverly J. Schreck, Sioux Falls, was appointed on July 24, 1998, to the Board of Vocational Rehabilitation to replace Monica Degen, effective immediately and to continue until July 1, 1999.

Allen L. Lewis, Sioux Falls, was appointed on July 24, 1998, to the South Dakota Development Corporation, effective immediately.

Terry C. Anderson, Pierre, was reappointed on July 27, 1998, to the State Arts Council, effective immediately and to continue until July 1, 2001.

Executive Orders:

Executive Order 98-05, dated July 28, 1998, creates the Workers' Compensation Task Force to advise the Department of Labor on issues related to the costs and benefits of workers' compensation insurance. The task force will investigate workers' compensation insurance costs and benefits in the state and recommend possible changes in the workers' compensation insurance laws. The Governor will appoint the members of the task force. The task force will report to the Governor and the Secretary of the Department of Labor by December 31, 1998, and will cease upon the completion of its report.

Rules Review Committee Meeting:

The next meeting of the Interim Rules Review Committee will be held August 24, 1998, in Rooms LCR 1 and 2, Third Floor, State Capitol, Pierre, starting at 9:00 a.m. Agencies whose rules have had a public hearing are asked to have a representative present at the meeting to give background information on their rules.
